Terms
Terms of service
The terms for using SuperScreencast and this website — short, plain, and in plain sight.
§1 · Scope
These terms govern the use of the SuperScreencast application, this website, and any paid offering, and are concluded between you and Merola Software & Services, Wartauweg 19, 8049 Zurich, Switzerland (see the imprint). By downloading or using SuperScreencast, you accept these terms.
§2 · What the terms cover
- SuperScreencast Community — the complete SuperScreencast application for capture, composition, the virtual camera, and recording. Free of charge, including streaming.
- SuperScreencast Pro — a perpetual license adding cinematic zoom, local transcription and subtitles, and speaker notes to the same application. Available features depend on the supported release; roadmap features are not included until delivered.
The three output lanes (virtual camera, recording, streaming) share one composition; these terms apply to the product as a whole regardless of which lanes you use.
§3 · License and source code
The SuperScreencast source code is developed in the open and made available under the license published with the source in its repository; that license governs the code itself. These terms govern your use of the packaged application, this website, and Pro services. Where the code license and these terms overlap, the code license prevails for the source code.
§4 · Acceptable use
- You are the broadcaster. Content you record or stream, and the rights to it, are your responsibility. Make sure you have the consent of everyone appearing in your recordings or streams where the law requires it.
- You hold your credentials. Streaming uses a stream key from a file on your machine. Keep that file secure; do not broadcast content you are not authorised to broadcast.
- No misuse of the service. Do not use this website or Pro services to harm the service, other users, or third parties, or to circumvent licensing.
§5 · Pro licenses
A one-time Pro purchase covers one individual user on up to three devices, for personal or commercial work. It includes minor updates within the purchased major version series for one calendar year from license issuance. Already eligible releases remain usable indefinitely. Support is by email only, without a promised response time.
If unsatisfied, request a refund within seven calendar days after purchase by emailing [email protected] with your order reference or purchasing email address. No justification is required. After a refund, stop using Pro and delete your license copies. Mandatory consumer rights, including any longer withdrawal period, remain unaffected.
The full Pro license agreement governs the Pro license and prevails over this summary for Pro-specific terms.
§6 · Prices and taxes
Prices and currencies are stated on the pricing page. The applicable taxes and total payable amount must be disclosed before payment.
§7 · No warranty
SuperScreencast is provided as-is. To the extent permitted by law, we disclaim warranties of uninterrupted operation, fitness for a particular purpose, and non-infringement. Capture behaviour depends on your desktop environment, display server, and audio system; limitations of specific backends are documented in the product. Streaming quality and availability depend on your network and your streaming destination, which we do not operate.
§8 · Liability
To the extent permitted by law, liability for ordinary negligence, indirect or consequential losses, lost profits and lost data is excluded. These exclusions do not apply to intentional misconduct, gross negligence, death or personal injury, or liability that cannot legally be excluded. Mandatory consumer rights remain unaffected. Back up your recordings and configuration.
§9 · Changes
We may develop SuperScreencast and revise terms for future purchases or upgrades. Revisions do not retroactively reduce perpetual rights already purchased. Materially different terms will be presented separately.
§10 · Governing law and jurisdiction
Swiss substantive law governs these terms. Subject to mandatory law, the courts in Zurich, Switzerland have jurisdiction. Consumers retain mandatory protections applicable in their country of habitual residence and any right to bring proceedings in another competent forum.
§11 · Contact
